1. Who you're contracting with
These Terms form a contract between you and Hueme™ Colour App ("Hueme", "we", "us") covering your use of the Hueme website, app and AI try-on service (together, the "Service"). By creating an account, subscribing or otherwise using the Service you agree to these Terms.
2. Eligibility
You must be 16 or older (or the digital-consent age in your country) to use the Service. By using it you confirm you have the right to do so.
3. The Service
Hueme provides a personal color-analysis tool: a quiz, season palettes, a digital colour fan, full-bleed "shop mode" swatches, and an AI-powered try-on that generates images of you wearing colours from your palette. Features may evolve over time.
4. Subscription plans, fair-use & payment
Plans currently offered:
- HUEME Glow — £4.99/month, personal use, up to 60 AI try-on generations per billing month.
- HUEME Pro — £14.99/month, for working colour analysts, up to 250 AI try-on generations per billing month, suitable for use with paying clients.
- HUEME Studio — £28/month, advanced & white-label tier for professional businesses; includes everything in Pro plus white-label branding, custom reports, premium exports, advanced AI tools, analytics and priority support. Fair-use AI try-on cap applies.
- Top-up pack — £1.99 one-off, +50 try-ons added to the current month.
The AI try-on caps exist because each generation has a real third-party cost. If you reach your cap before the month resets, you can wait for the next cycle or buy a top-up pack — your colour fan, shop mode and saved palette remain fully available regardless. Caps reset on your billing date and unused try-ons do not roll over.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms.
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from the customer portal (paddle.net) — cancellation stops the next renewal but does not retroactively refund the current period (see Refund Policy).
5. Your account
Keep your sign-in credentials confidential. You are responsible for activity under your account. Tell us promptly if you suspect unauthorised use.
6. Acceptable use
You agree not to:
- Use the Service unlawfully, fraudulently or to spam.
- Upload photos of anyone other than yourself, or anyone who has not given clear consent.
- Upload content that is illegal, hateful, sexually explicit, infringes IP, or depicts minors in a way that violates child-safety laws.
- Use AI try-on to create deepfakes, impersonate others, harass, defame or mislead.
- Reverse-engineer, scrape, probe, or interfere with the Service or its security.
- Resell, sub-license or redistribute the Service or its outputs in a way that competes with Hueme (the Analyst Pro tier explicitly permits use within paid client consultations).
7. Your content (photos & inputs)
You retain ownership of photos you upload. You grant us a limited, worldwide, royalty-free licence to host, process and transmit your content solely to operate the Service (including sending it to our AI sub-processor to generate try-on images). We do not use your photos to train AI models.
You confirm you have all necessary rights and consents to upload any photo you submit.
8. AI-generated outputs
The AI try-on produces visual approximations, not exact representations. Skin tone, hair, fit, fabric and lighting can render imperfectly. Do not rely on outputs for regulated decisions (medical, legal, professional). Outputs may sometimes be inaccurate, distorted or unflattering — you accept this is the nature of generative AI.
You are responsible for how you use generated images. We may filter, refuse or remove generations that violate §6, and may suspend or terminate accounts for repeated or serious violations. We comply with valid takedown requests from rights-holders and may terminate repeat infringers.
9. Our IP
The Service, brand, software, palette names and curated content are owned by Hueme or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in line with your active plan.
10. Service level
We work hard to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features.
11. Suspension & termination
We may suspend or terminate your access for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated violations of acceptable use. You may close your account at any time. On termination, your data is handled per our Privacy Notice.
12. Warranties & liability
The Service is provided "as is". To the fullest extent permitted by law, we disclaim all implied warranties (merchantability, fitness for purpose, non-infringement). We are not liable for indirect, consequential, special or incidental losses, including loss of profits, data or goodwill. Our total aggregate liability for any claim is capped at the fees you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.
13. Indemnity
You will indemnify Hueme against claims arising from content you upload, your unlawful use of the Service, or your breach of these Terms.
14. Governing law
These Terms are governed by the laws of England & Wales. Disputes are subject to the exclusive jurisdiction of the courts of England & Wales, except that consumers retain any non-waivable rights under their local law.
15. Changes
We may update these Terms. Material changes will be notified in-app or by email at least 14 days before they take effect.
